Your contract is with Sula Expeditions Ltd, a company registered in Scotland with company no. SC857556 and registered office address of 3 Regent Street, Keith, AB55 5DW, operating under the Trade Name Mull Wildlife Breaks.
We set out below an explanation of the conditions that apply when you enter into a contract with us. It is important that you read these conditions together with the Break information, as they not only define our obligations to you but also impose some important commitments upon you.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:
- he/she/them has read these Booking Conditions and has the authority to and does agree to be bound by them;
 - he/she/them consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
 - he/she/them accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

1. YOUR CONTRACT
When you make a booking you guarantee that you have the authority to accept, and do accept on behalf of your party, the terms of these booking conditions. A contract will exist as soon as you pay us a 50% deposit (or full amount if you book within a 10 week period before the start date of your Break) and we issue you a confirmation email. Once you have received the confirmation email, it is your responsibility to check that the information and booking details, as stated in the email, are correct. If any of the details are incorrect, you must notify us immediately. We reserve the right to refuse to accept and/or not proceed with any booking at any time at our own discretion.
2. ACCURACY
We endeavour to ensure that all the information and prices both are accurate, however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before you make your booking.
3. THE PRICE
We guarantee that the price of your Break will not be subject to any surcharges once a contract exists between you and us. Break prices can be influenced by taxes, personnel costs, the price of fuel and other associated costs. The price shown is based on current charges and costs but they may go up or down; we reserve the right to alter the price of our Breaks, introduce supplements or correct pricing errors, and will notify you of the current price prior to any booking – please call or visit our website for the most up-to-date price. The price of your Break as shown in your booking confirmation will not be increased unless you amend your booking. However, we reserve the right not to be legally bound in the case of incorrect pricing and acknowledgement of such an error does not mean acceptance of it. We have a price promise guarantee for the price of our Breaks.
4. PAYING FOR YOUR BREAK
Unless otherwise specified – when you make your booking, you are required to pay a deposit of 50% of the full amount due for the booking. The 50% balance of the full amount is due 10 weeks prior to the start of your Break.
5. INSURANCE
Adequate travel insurance is a condition of your contract with us.. You must be satisfied that your insurance fully covers all your personal requirements including pre-existing medical conditions, cancellation charges, medical expenses and repatriation in the event of an accident or illness. If you choose to travel without adequate insurance cover, neither we nor the Supplier/Principal will be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.
6. IF YOU CHANGE YOUR BOOKING
Once a contract exists between you and us, you may wish to change your Break arrangements. For example, your dates,, type of room, etc. and we will do our utmost to make these changes but it may not always be possible. You will be asked to pay any appropriate costs for the alteration.
7. IF YOU CANCEL YOUR BOOKING
Once a contract exists between you and us, you have the right to request to cancel your booking and any refund due to you will be calculated as follows:
- A cancellation request which is received more than 10 weeks in advance of the Break shall be entitled to a full refund of your deposit.
 - A cancellation request which is received within 10 weeks of the Break shall not be entitled to a refund and the 50% balance of the full amount will still be due.
 
8. IF WE CHANGE OR CANCEL YOUR BOOKING BEFORE DEPARTURE
Occasionally, we may have to make changes to your booking and we reserve the right to do so at any time. In the case where we make an alteration or alterations to your booking, in advance of the start date and time of your Break, you will be given the opportunity to cancel your booking and receive a full refund.
We also reserve the right to cancel your Break at any time prior to the start date of your Break. For example, if the minimum number of guests (4) required to operate a Break is not reached, or the weather is unsuitable for the Break to proceed as planned, then we may cancel it. If we are unable to provide the booked Break, you can either have a full refund of all monies paid, or accept an offer of an alternative Break, where available. Please note that we do not have any responsibility or liability for any consequential loss you may incur from arrangements you have made with any other party or parties.
9. IF WE CHANGE OR CANCEL YOUR BREAK AFTER DEPARTURE
On very rare occasions we may have to make changes to the Break whilst it is underway. Unforeseen circumstances including, but not limited to, mechanical failure, unexpected weather and illness or injury of one or more persons on the Break may result in the tour program and duration being altered. In cases such as these, appropriate compensation may be offered at the discretion of the management of Sula Expeditions Ltd. The value of compensation will not exceed the value of the booking (i.e. a full refund may be made and a gift certificate offered of equivalent value to the booking).
10. REFUNDS
If you are entitled to a refund relating to your booking this will usually be made by the same payment method that was used to pay us. Any fees incurred when making a payment will not be refunded unless we cause the cancellation.
11. DELAYS, MISSED TRANSPORT ARRANGEMENTS AND OTHER TRAVEL INFORMATION
It is your responsibility to reach the Break meeting point and join the party as listed in our correspondences. If you and your party are not present at the noted Break start, we reserve the right to identify this as a ‘no show’ and in such circumstances, this will be a cancellation by you and such charge will be 100% of the travel arrangement cost.
We are not responsible for any ferry you may book to reach us. We advise you to read the ferry company terms and conditions carefully. You may have rights in some circumstances to refunds and/or compensation from them in cases of denied boarding, cancellation or delayed sailings.
As well, we do not offer flights and we are not responsible for any flight you may otherwise book in order to reach us. In the event that you make such a booking, please read your flight terms and conditions carefully. You may have rights in some circumstances to refunds and/or compensation from the airline in cases of denied boarding, cancellation or delay to flights. Contact your airlines or the third party you made a flight booking with for more information.
12. IF YOU HAVE A COMPLAINT
We are proud of our high reputation for customer satisfaction and strive to reach amicable settlement of the very small number of complaints we receive. If you have a problem or cause for dissatisfaction, please inform us at the earliest opportunity (this will often be by informing a member of staff during the tour). This allows us the opportunity to put things right on the spot. Your responsibilities are as follows:
You are responsible for the behaviour of yourself and your party. We reserve the right to refuse your booking or to remove you or a member of your party from any Break, if your demeanour or behaviour, or that of a member of your party, is disruptive, dangerous, upsetting to other people or disruptive to the safety of the wildlife. No refund or payment of any costs incurred by you will be made by us under these circumstances.
Each guest is responsible for their personal safety and the safety of their personal possessions whilst on board, embarking and disembarking any Break. Any minors and incapable individuals are in the care and under the supervision of a sane and knowledgeable adult at all time on land, when on the boat excursion and in close vicinity to wild animals and in wildlife areas, or at any given time it may be deemed fit for supervision.
These responsibilities will also apply during our sea safari expedition, using Staffa Tours. By entering into a contract with us, you have therefore agreed to comply with any instructions or guidance given by crew members. These instructions pertain directly to your safety and wellbeing onboard the vessel and whilst ashore on the Treshnish Islands, and are therefore of utmost importance. Please note that we reserve the right to change our sea safari provider in case of cancellation, adverse weather or unexpected circumstances. If that were to happen, you will still be expected to follow the guidance and instructions provided by the crew of any alternative company.
13. MOBILITY AND ASSISTANCE
It is your responsibility to ensure that you are fit to travel on the departure date. We aim to be as inclusive as possible on our Breaks, and we will do our utmost to cater for any special requirements you may have. If you, or any member of your party has any medical problem or disability which may affect your booking, please provide us with full details before you make your booking so that we can try to advise you as to the suitability of our Breaks. We may require you to produce a doctor’s certificate certifying that you are fit to participate. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.
14. MEDICAL INFORMATION
You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us as early as possible in advance of your Break and no later than 48 hours before departure. This is essential for all bookings. Women who are pregnant are welcome at all stages of pregnancy but be aware that during the course of the tour we may be, at times, several hours from medical assistance.
13. DATA PROTECTION ACT
By providing us with your personal data and contact details, you consent to the use of that data and to you being contacted by Mull Wildlife Breaks by post, email, SMS or other electronic means, to inform you about any products and services which it considers may be of interest to you unless you have stated otherwise. When you provide information about another person, we accept it on the basis that you have their permission to give us access to their personal data (including any sensitive personal data) and that you have told them who we are and what we will use their data for, as set out above.
